Military Separation

An individual may face premature separation and potentially an administrative board for many reasons, such as:

  • Military misconduct, such as drug abuse
  • Pattern of misconduct
  • Commission of a serious offense
  • Civilian conviction
  • Homosexuality
  • Physical disability or medical reasons
  • Failure of selection for promotion
  • Substandard performance of duty

Right to an Administrative Separation Board Hearing

Individuals, who have been enlisted for more than six years, or have a possibility of receiving an Other Than Honorable discharge (OTH), are automatically entitled to a hearing before an administrative separation board. Individuals with less than six years of service may challenge separation by means other than an administrative separation board hearing. An administrative separation board consists of three officers who will hear all evidence and make a recommendation to the admiral or general officer making the final decision. The recommendation may involve:

  • Is there cause to discharge?
  • Should there be a discharge?
  • If a discharge is necessary, what is the board's recommendation for discharge (honorable, general-honorable, general-other than honorable)?

Attorney Patrick J. McLain knows how to get the right answers to all of these questions.

Experienced Advocacy

Although many active duty lawyers are quick to waive an individual's right to this hearing, Attorney Patrick J. McLain has proved to be successful in recovering favorable outcomes in these matters by utilizing one's right to a hearing. If you face involuntary separation, you are entitled to a specific process.
